The agency may authorize advance payments in negotiated and sealed bid contracts if the action is appropriate under-

1. (a) 41 U.S.C. chapter 45;

2. (b) 10 U.S.C. chapter 277; or

3. (c) Pub.L.85-804 (50 U.S.C. 1431-1435) and Executive Order10789, November 14,1958 (3 CFR1958 Supp. pp. 72-74) (see subpart  50.1 for other applications of this statute).
